Title of bill
An act to authorize Esther Beck to file an application for exemption from real property taxes for a certain parcel of land located in the town of Brookhaven, county of Suffolk
Purpose
To provide Esther Beck, a resident of the Town of Brookhaven, the opportunity to receive the STAR exemption and refunds for the years 2000 through 2004 which were not paid to her due to an error in the assessor's office.
Summary of provisions
Provides Mrs. Beck the right to receive STAR exemptions for those four years provided she otherwise was entitled to the exemption. The bill also provides for the Town of Brookhaven to refund the amount of the exemption which was due her.
Existing law
The error in Mrs. Beck's assessment was made in 2001 by the Assessor's Office through no fault of Mrs. Beck. The error was not discovered until 2007 and existing law only allows the Town to go back three years to correct the errors.
Justification
This bill would allow the Town of Brookhaven to correct the error which resulted in Mrs. Beck being deprived of her STAR Benefits. This individual properly filed for her exemption and had the reasonable expectation that the exemption would be applied from year to year.
