Title of bill

An act to amend the penal law, in relation to making a false bomb threat in or upon a school

Purpose of bill

To deter those from making, and to punish those who make, false bomb threats to schools or colleges.

Summary of specific provisions

Section 1 creates the crime of making a false bomb threat in or upon a school. Provides that a person is guilty of making a false bomb threat upon a school when such communication is made to said school and it reasonably appears that such threat is real. The first violation of this section shall be a class A misdemeanor; second and additional violations shall be a class E felony.

Section 2 provides that this act shall take effect 90 days after it shall have become law.

Justification

A false report of a bomb threat to a school is not a harmless prank. Today, in the wake of such tragedies as Columbine High School and Virginia Tech, threats of violence on our campuses are treated with the utmost seriousness by our school officials and law enforcement agencies who respond with the immediate urgency such a situation warrants. Recently, students at Weber Middle School in Port Washington were evacuated after two separate bomb threats, which were later found to be false reports, were made.

When students lives are threatened, the first response must be to remove them from harm's way before determining whether the threat is real or not. These false reports often distract law enforcement officials from more serious police business resulting in a waste of resources to the community. This legislation will provide greater awareness of the seriousness of such incidents and serve as a deterrent to those who may engage in such behavior.
