(518) 371-8910 1 amending the Labor Law. 2 ACTING PRESIDENT BRESLIN: 3 Senator DeFrancisco, why do you rise? 4 SENATOR DeFRANCISCO: I have an 5 amendment at the desk, and I'd waive its 6 reading and move its adoption. 7 ACTING PRESIDENT BRESLIN: Thank 8 you, Senator DeFrancisco. The reading of the 9 amendment is waived, and you may be heard on 10 the amendment. 11 SENATOR DeFRANCISCO: Thank you. 12 ACTING PRESIDENT BRESLIN: Excuse 13 me, Senator DeFrancisco. 14 Senator Klein. 15 SENATOR KLEIN: Mr. President, 16 point of order. 17 ACTING PRESIDENT BRESLIN: Yes, 18 Senator Klein. 19 SENATOR KLEIN: Mr. President, 20 this amendment is not germane to the purpose 21 of this bill, and I believe that it should be 22 ruled out of order. 23 Calendar 93 relates to work 24 practices, procedures, and standards to
Candyco Transcription Service, Inc.
(518) 371-8910 1 protect persons who work on high-voltage 2 lines. The amendment that's proposed by 3 Senator DeFrancisco would make funds available 4 to help municipalities, citizens and community 5 groups intervene in proposed electric 6 transmission projects. 7 The past practice of the Senate has 8 been to apply the common definition of the 9 term "germane," which is being relevant to the 10 matter at hand. Using our standard, 11 Mr. President, the amendment is not germane to 12 the purpose of this bill that it would amend. 13 ACTING PRESIDENT BRESLIN: Thank 14 you, Senator Klein. 15 SENATOR DeFRANCISCO: May I be 16 heard on the issue of germaneness? 17 ACTING PRESIDENT BRESLIN: 18 Senator DeFrancisco, the ruling of the chair 19 is the amendment is out of order. 20 SENATOR LIBOUS: Mr. President, I 21 appeal the ruling of the chair. 22 ACTING PRESIDENT BRESLIN: The 23 ruling of the chair can be appealed. 24 The question before the house is
Candyco Transcription Service, Inc.
(518) 371-8910 1 should the ruling of the chair be overruled. 2 All those in favor of overruling -- 3 SENATOR LIBOUS: Mr. President, I 4 believe we have an opportunity to speak on why 5 it's germane. 6 SENATOR KLEIN: Mr. President, 7 the ruling is on germaneness. 8 ACTING PRESIDENT BRESLIN: Right. 9 I don't believe there's a debate on the 10 germaneness of the ruling. 11 SENATOR LIBOUS: Yes. Yes, 12 Mr. President, I believe there is. 13 ACTING PRESIDENT BRESLIN: 14 Senator DeFrancisco, there is no appeal under 15 the rules, of an appeal to the chair. You can 16 talk about the underlying bill itself. 17 SENATOR DeFRANCISCO: Well, how 18 about if I speak about both, because 19 apparently there's some confusion at the desk. 20 Because if there's a ruling on 21 germaneness, I would assume that someone who 22 feels that ruling was wrong would have an 23 opportunity to convince his or her fellow 24 Senators that the ruling was wrong, and they
Candyco Transcription Service, Inc.
(518) 371-8910 1 may want to vote the other way on an appeal. 2 And if we can't express our reasons 3 why it's not germane, then -- 4 ACTING PRESIDENT BRESLIN: You 5 were premature, possibly, in asking for a 6 ruling. 7 SENATOR DeFRANCISCO: May we have 8 a moment, please? 9 ACTING PRESIDENT BRESLIN: Sure. 10 (Pause.) 11 SENATOR KLEIN: Mr. President. 12 ACTING PRESIDENT BRESLIN: 13 Senator Klein. 14 SENATOR KLEIN: Can you please 15 recognize Senator DeFrancisco to speak on why 16 he believes his amendment is germane. 17 ACTING PRESIDENT BRESLIN: 18 Senator DeFrancisco, to speak on the 19 germaneness of the issue. 20 SENATOR DeFRANCISCO: Thank you. 21 And I appreciate the opportunity to 22 speak on this motion, which has always been 23 debatable in the past. And it's especially 24 appropriate during Sunshine Week, and with the
Candyco Transcription Service, Inc.
(518) 371-8910 1 new leadership expressing their willingness to 2 make sure the process is fair to all sides. 3 And it's nice that we're able to do 4 what we've always been able to do by the new 5 ruling on germaneness. 6 This particular bill, the 7 amendment, deals with the same topic as the 8 original bill that Senator Valesky is 9 sponsoring, 2577. As Senator Klein mentioned, 10 that bill deals with the safe work practices 11 for the safety of people working on lines, 12 high-energized voltage lines, that protect 13 those people that happen to be working on 14 those projects. 15 This amendment deals with a fee 16 that would be charged to transmission 17 projects, to the people pursuing transmission 18 projects, so that the municipalities can 19 effectively protect their citizens, who are 20 not -- who could be people working on power 21 lines, they could be the general public -- 22 that they're required to make sure are safe 23 from danger, including danger from these 24 lines.
Candyco Transcription Service, Inc.
(518) 371-8910 1 Right now municipalities don't have 2 that opportunity to raise the funds without a 3 pot of money created by this amendment, which 4 amendment would in fact allow the 5 municipalities to contest some of these 6 projects and/or modify the projects for the 7 health and safety of the people in their 8 community as well as the environment. 9 So I believe for those reasons, 10 Mr. President, this amendment -- could you 11 call for some order? 12 ACTING PRESIDENT BRESLIN: Can we 13 please have some order to allow Senator 14 DeFrancisco to speak. 15 Senator DeFrancisco. 16 SENATOR DeFRANCISCO: So I 17 believe that due to the safety issues in both 18 the bill and the amendment, that this is 19 germane. 20 And I call upon all colleagues in 21 the Senate to at least allow the amendment to 22 be formally debated for the consideration of 23 the rest of the house on this particular 24 amendment.
Candyco Transcription Service, Inc.
(518) 371-8910 1 Thank you. 2 ACTING PRESIDENT BRESLIN: Thank 3 you, Senator DeFrancisco. 4 The question shall be on the ruling 5 of the chair, should it be overruled. 6 Senator Bonacic. 7 SENATOR BONACIC: Thank you, 8 Mr. President. 9 First of all, I think the present 10 bill is a good bill. The issue is public 11 safety. And the amendment was also a bill 12 that Senator Valesky and I cosponsored, this 13 amendment that goes to public safety. So the 14 nexus of the bill, and germaneness, is public 15 safety. 16 The main bill deals with the safety 17 of workers. The amendment deals with the 18 safety of communities, for a fund on 19 environmental safety, on visual pollution, on 20 health hazards that may emanate from the 21 lines, as well as property damage to our 22 communities. 23 So for those reasons, on the issue 24 of safety, there's a nexus. And they're
Candyco Transcription Service, Inc.
(518) 371-8910 1 interrelated. And for those reasons, both the 2 Senator Valesky main bill and the amendment, 3 which is also a Valesky co-sponsored bill -- 4 which has already passed in the Assembly last 5 year -- we have an opportunity to make this 6 bill better. And it's something we all have 7 supported in the past. 8 So for those reasons, I would ask 9 the chair to reconsider that it is germane on 10 the issue of safety. 11 Thank you, Mr. President. 12 ACTING PRESIDENT BRESLIN: Thank 13 you, Senator Bonacic. 14 The question is on the ruling of 15 the chair, should it be overruled. All in 16 favor signify by saying aye. 17 (Response of "Aye.") 18 ACTING PRESIDENT BRESLIN: 19 Opposed, nay. 20 (Response of "Nay.") 21 ACTING PRESIDENT BRESLIN: The 22 nays have it. The ruling of the chair is 23 upheld. 24 The debate is closed.
Candyco Transcription Service, Inc.
(518) 371-8910 1 Ring the bells. 2 Come to your seats. 3 SENATOR WINNER: Point of order, 4 Mr. President. 5 ACTING PRESIDENT BRESLIN: 6 Senator Winner, point of order. 7 SENATOR WINNER: Could I inquire 8 of the chair as to -- 9 SENATOR LIBOUS: Can we have some 10 order in the chamber? I can't hear Senator 11 Winner's point of order to the chair. 12 ACTING PRESIDENT BRESLIN: Can we 13 please have order? Everyone taking their 14 conversations outside would be appreciated. 15 SENATOR LIBOUS: Thank you, 16 Mr. President. 17 ACTING PRESIDENT BRESLIN: Thank 18 you, Senator Libous. 19 Senator Winner. 20 SENATOR WINNER: Mr. President, I 21 just wanted to inquire of the chair, it's my 22 understanding that the ruling of the chair -- 23 there was a motion to overturn the ruling of 24 the chair. And a vote, therefore, in the
Candyco Transcription Service, Inc.
(518) 371-8910 1 affirmative would be to overturn the ruling of 2 the chair, and a vote in the negative would be 3 to uphold the ruling of the chair. 4 I believe it was misstated that 5 that was a vote -- that the motion was to -- 6 or an affirmative vote was to uphold the 7 ruling of the chair and a vote in the negative 8 was to -- 9 ACTING PRESIDENT BRESLIN: I 10 don't believe that's what I said. 11 SENATOR WINNER: Well, good, then 12 I'm glad that I wasn't hearing properly. 13 But then following that up, I'd 14 also like to make an inquiry as to what was 15 the vote on that motion. 16 ACTING PRESIDENT BRESLIN: 17 Overwhelming. 18 (Laughter.) 19 SENATOR WINNER: Is the vote 20 recorded? 21 ACTING PRESIDENT BRESLIN: No, it 22 is not, Senator. 23 SENATOR WINNER: Well, 24 Mr. President, I believe that we should have a
Candyco Transcription Service, Inc.
(518) 371-8910 1 recorded vote with regard to that motion. 2 ACTING PRESIDENT BRESLIN: It's 3 been the precedent and the rules that that is 4 not recorded, Senator Winner. 5 SENATOR KLEIN: Mr. President. 6 SENATOR WINNER: Could you make 7 reference to the rule, Mr. President, that 8 says that there not be a recorded vote on a 9 motion to overturn the ruling of the chair? 10 ACTING PRESIDENT BRESLIN: 11 Senator Klein -- excuse me, Senator Winner. 12 SENATOR KLEIN: Point of order, 13 Mr. President. This is done by a voice vote. 14 ACTING PRESIDENT BRESLIN: It's 15 done by a voice vote. And it's over with, 16 Senator Winner. 17 Read the last section. 18 SENATOR LIBOUS: Mr. President. 19 ACTING PRESIDENT BRESLIN: 20 Senator Libous, why do you rise? 21 SENATOR LIBOUS: I believe 22 Senator Winner asked a question, and I didn't 23 hear the answer. He asked if the rule could 24 be referred to.
Candyco Transcription Service, Inc.
(518) 371-8910 1 If indeed there is a rule in the 2 Senate that says it is a voice vote, I believe 3 Senator Winner's question to the chair was 4 could you please refer to the rule. Which 5 rule -- 6 ACTING PRESIDENT BRESLIN: It's 7 been the practice of this body that it would 8 be a voice vote, Senator Libous. 9 SENATOR LIBOUS: So there is no 10 official rule. 11 ACTING PRESIDENT BRESLIN: It's 12 the custom of this house that it's a voice 13 vote. 14 Why do you rise, Senator 15 Ranzenhofer? 16 SENATOR RANZENHOFER: I have a 17 question, Mr. President. 18 On a voice vote, is the 19 determination by who has more people voting or 20 who's louder? 21 ACTING PRESIDENT BRESLIN: I 22 think it's a sense of which side had more 23 votes voting and not who is the loudest, 24 Senator Ranzenhofer.
Candyco Transcription Service, Inc.
(518) 371-8910 1 SENATOR RANZENHOFER: Okay, thank 2 you. 3 ACTING PRESIDENT BRESLIN: You're 4 very welcome. 5 SENATOR LaVALLE: Mr. President. 6 ACTING PRESIDENT BRESLIN: 7 Senator LaValle, why do you rise? 8 SENATOR LaVALLE: Mr. President, 9 I'm going to request a slow roll call on this. 10 Tradition is not an answer. There 11 is either a rule or no rule, not tradition. 12 So I ask for a slow roll call. 13 ACTING PRESIDENT BRESLIN: 14 Senator LaValle, a slow roll call is only 15 warranted on final consideration of a bill or 16 resolution or a concurrent resolution. 17 SENATOR LaVALLE: Mr. President, 18 could you -- 19 ACTING PRESIDENT BRESLIN: That 20 would be Rule 8, Section 6. 21 SENATOR LaVALLE: Okay, thank 22 you. 23 SENATOR KLEIN: 6(B). 24 ACTING PRESIDENT BRESLIN:
Candyco Transcription Service, Inc.
(518) 371-8910 1 Section 6(B). 2 Read the last section. 3 THE SECRETARY: Section 2. This 4 act shall take effect immediately. 5 ACTING PRESIDENT BRESLIN: Call 6 the roll. 7 (The Secretary called the roll.) 8 ACTING PRESIDENT BRESLIN: 9 Senator Valesky, to explain his vote. 10 SENATOR VALESKY: Thank you, 11 Mr. President. 12 I rise to explain my vote in the 13 affirmative, in particular because I'm a bit 14 concerned that the conversation this afternoon 15 has taken away from the importance of the 16 legislation that's before us. 17 It's my understanding that in 1974 18 the State Legislature, and a number of times 19 since then, approved legislation that governs 20 the physical safety of those 21 high-voltage-electric-line workers. And we 22 did so again, I believe, just last session. 23 It seems to me that it makes 24 perfect sense to not allow this law to sunset
Candyco Transcription Service, Inc.
(518) 371-8910 1 in the future, because what we are doing is 2 considering something extremely important, and 3 that is the personal health and safety of 4 those workers, who perform very dangerous 5 work. 6 It does not seem to make sense that 7 every few years those electrical workers would 8 have to go through a process by which they 9 come to this Legislature on a matter of their 10 own personal safety and ask and request their 11 Legislature and their Governor to extend the 12 law. Which is what has happened for the past 13 35 years. 14 Upon passage of this bill today in 15 this house, hopefully the Assembly will follow 16 suit, the Governor will sign that bill into 17 law, and the electrical workers in this state, 18 who perform a very dangerous function, will no 19 longer have to be concerned about whether or 20 not this law would be extended in the future. 21 So I am pleased to support this 22 bill. I ask members on both sides of the 23 aisle to support this bill as well and ask 24 that it be moved at this time.
Candyco Transcription Service, Inc.
(518) 371-8910 1 I vote in the affirmative. Thank 2 you, Mr. President. 3 ACTING PRESIDENT BRESLIN: Thank 4 you, Senator Valesky. 5 Senator DeFrancisco, to explain his 6 vote. 7 SENATOR DeFRANCISCO: Yes, I 8 agree with Senator Valesky that this is a good 9 bill. We should always protect the safety of 10 our workers, especially in high-risk jobs. 11 But we should also protect the 12 safety of everybody else in that community. 13 And that's why it's a little bit distressing 14 that a bill that Senator Valesky also sponsors 15 was our very amendment, so he understands how 16 important it is for that bill to pass. 17 And it could have been a much 18 broader bill that protected more people. And 19 it just seems unbelievable that it would not 20 even be considered today when there's a 21 sponsor who's sponsoring the underlying 22 legislation who's in support of it. 23 There's only one possible reason 24 for that. It's because the new Majority has
Candyco Transcription Service, Inc.
(518) 371-8910 1 not brought that bill themselves to the floor. 2 And this is the type of practice that we would 3 hear over and over again that was going to 4 change on day one; the reform, the system was 5 going to be different. And so that's the only 6 reason that our amendment wasn't voted on it. 7 And it's wrong. 8 Secondly, Senator Valesky 9 mentions -- and I do support the bill, and 10 it's important to protect electrical workers. 11 But the current bill doesn't expire till the 12 year 2013, four years from now. 13 And I understand the importance of 14 it, but how could this bill be so urgent or 15 more urgent than passing a one-house budget in 16 this Senate so we can go to conference 17 committees? Which, by the way, happen to be 18 part of the process that we adopted by the 19 Legislature so that we could have a budget 20 that is open and discussed in public. 21 So, you know, there is so much 22 hypocrisy that we see by just this little 23 amendment. And I think the public out there 24 should know about it. Despite the fact that
Candyco Transcription Service, Inc.
(518) 371-8910 1 the bill is a good bill, it's certainly not as 2 urgent as a one-house budget bill that we 3 could start the public process. 4 So I vote in the affirmative. 5 ACTING PRESIDENT BRESLIN: Thank 6 you, Senator DeFrancisco. 7 Senator Craig Johnson. 8 SENATOR CRAIG JOHNSON: Thank 9 you, Mr. President. I rise to explain my vote 10 and to vote in the affirmative. 11 And I commend Senator Valesky on 12 this piece of legislation. I think, 13 notwithstanding a point about the timing, I 14 think what's important is getting the job done 15 now, making sure that our electrical workers 16 don't have to worry year after year as the 17 clock ticks by as to whether or not they're 18 going to have the permanent protection that 19 they should be afforded. 20 But I sat here today during the 21 debate and just was amazed about how all of a 22 sudden at this point in time the amendment 23 that was offered up by the Minority took such 24 importance when the same bill offered by
Candyco Transcription Service, Inc.
(518) 371-8910 1 Senator Valesky was before the Minority when 2 they were in the Majority. 3 Where were you last year when 4 Senator Valesky had the very same bill? You 5 were silent. You were quiet. And it's now 6 all of a sudden, right now, this becomes the 7 most important thing of the day. 8 I would watch what we say when we 9 talk about the word "hypocrisy." I would 10 watch what we say when we use that word. It's 11 a very strong word. And we should all respect 12 one another in this house. 13 The important thing today is what 14 Senator Valesky is accomplishing. It's a very 15 good bill. The electrical workers of this 16 state are here to be protected, and I commend 17 Senator Valesky. 18 I vote aye, Mr. President. 19 ACTING PRESIDENT BRESLIN: 20 Senator Morahan, why do you rise? 21 SENATOR MORAHAN: I was just 22 going to explain my vote as well. 23 But I'm curious about the 24 statements made by Senator Johnson, in that I
Candyco Transcription Service, Inc.
(518) 371-8910 1 don't believe this bill was ever on the floor 2 for us to vote on this bill last year. I 3 believe this bill may have never received the 4 proper committee approval; therefore, it 5 wasn't here, for whatever reason. 6 But to say that we didn't vote for 7 it on the floor is not quite accurate. I 8 don't believe it was on the floor last year. 9 I vote yes. 10 ACTING PRESIDENT BRESLIN: Thank 11 you, Senator Morahan. 12 Senator Bonacic, to explain his 13 vote. 14 SENATOR BONACIC: Explaining my 15 vote, and more as a response to Senator 16 Johnson. 17 To refresh your recollection, the 18 Senate Majority, on the subject of the 19 amendment, came up with a million dollars to 20 fight the NYRI line. The amendment deals with 21 $450,000 to make the utilities pay for future 22 fights. 23 So when you speak of hypocrisy, the 24 Senate Majority, when they were in power,
Candyco Transcription Service, Inc.
(518) 371-8910 1 acted to put up the money to accomplish what 2 we wanted this amendment to accomplish in the 3 prospective years. Just clarifying the 4 record. 5 I think it's a good bill that 6 Senator Valesky put forward. He's got the 7 unanimous consent of everyone on the floor, 8 and that's a good way to proceed for good 9 legislation. 10 But to throw aspersions of 11 hypocrisy, I think that erodes future 12 cooperation. 13 ACTING PRESIDENT BRESLIN: Thank 14 you, Senator Bonacic. 15 Announce the results. 16 THE SECRETARY: Ayes, 61. Nays, 17 0. 18 ACTING PRESIDENT BRESLIN: The 19 bill is passed. 20 Senator Klein, that completes the 21 controversial reading of the calendar. 22 SENATOR KLEIN: Mr. President, 23 can we please recognize Senator Ruth 24 Hassell-Thompson for a brief announcement.

(518) 371-8910 1 ACTING PRESIDENT BRESLIN: 2 Senator Hassell-Thompson. 3 SENATOR HASSELL-THOMPSON: Thank 4 you, Mr. President. 5 Immediately following today's 6 session will be a meeting of the Majority in 7 Conference Room 332. Immediately following 8 session. 9 ACTING PRESIDENT BRESLIN: There 10 will be a meeting of the Majority in the 11 Majority Conference Room immediately following 12 session, in Room 332. 13 Senator Klein. 14 SENATOR KLEIN: Mr. President, is 15 there any further business at the desk? 16 ACTING PRESIDENT BRESLIN: 17 Senator Klein, the desk is clear. 18 SENATOR KLEIN: There being none, 19 I move that we adjourn until Tuesday, 20 March 17th, at 3:00 p.m. 21 ACTING PRESIDENT BRESLIN: There 22 being no further business to come before the 23 Senate, on motion, the Senate stands adjourned 24 until Tuesday, March 17th, at 3:00 p.m.
