BILL NUMBER:S1117

Title of bill

An act to amend the navigation law, in relation to the detection of petroleum discharges

Purpose

It is the purpose of this bill, to ensure a clean environment and a healthy economy for the state by allowing the early discovery of discharges of petroleum that may result in damages to lands, waters or natural resources of the state. This legislation increases the ability of the Department of Environmental Conservation to respond quickly to discharges.

Present law refers only to the early detection of leaks and neither refers explicitly to the prompt detection of sudden discharges, nor requires installation of equipment to promptly detect petroleum discharges from a tank or connected pipeline.

Summary of provisions

Section 1 - would amend subdivision 174 of the navigation law such that as a condition to the issuance or renewal of a license, the Department of Environmental Conservation shall require satisfactory evidence that the applicant has implemented or is in the process of implementing state and federal plans and regulations for the prompt detection of the accidental discharge of petroleum.

Section 2 - would add a new paragraph to subdivision 9 of section 174 of the navigation law, creating a duty to "promptly detect" discharges of petroleum.

Section 3 - would add two new subdivisions to section 174 of the navigation law, providing that within one year of the date of this bill, major facilities must install equipment to promptly detect discharges of petroleum from a tank and any connected pipelines that routinely contain petroleum.
