BILL NUMBER:S1457A
Title of bill
An act to amend the public health law, in relation to personal watercraft and certain safety provisions that require their use; and to amend the navigation law, in relation to making technical corrections thereto
Purpose
This legislation relates to personal watercraft and certain safety provisions that require their use.
Summary of provisions
This legislation amends paragraph (a) of subdivision 2 of Section 1341 of the Public Health Law to allow bathing establishments to keep and maintain a personal watercraft vessel as defined in subdivision 30 of Section 2 of the Navigation Law and in compliance with the regulations of the Commissioner, to assist in the rescue of persons in danger of drowning.
Justification
This legislation is being introduced at the request of the Hampton Lifeguard Association (HLA). One of the many programs the HLA has been sponsoring for over eight years is the Volunteer Ocean Rescue Squad. This team consists of over 40 ocean-certified members who respond and make ocean rescues at any unprotected beach, day or night, all year long. Their goal is to have at least five rescue swimmers at the rescue site with the necessary safety equipment in less than five minutes.
Section 1341 of the Public Health Law relates to safety requirements for bathing establishments along the seashore of the State of New York. It requires persons maintaining any such bathing establishment to keep and provide a surfboat measuring at least sixteen feet long for the facilitation of the rescue of persons in danger of drowning. In an effort to enhance response time and rescue operations, this measure makes these provisions for personal watercrafts as well.
