BILL NUMBER:S1510

Title of bill

An act to amend the penal law and the executive law, in relation to establishing the crime of criminal sale of an internet domain name to a terrorist group

Purpose

This bill establishes the crime of criminal sale of an Internet domain name to a terrorist group.

Summary of provisions

The penal law is amended by adding a new section 490.60 to establish the crime of criminal sale of an Internet domain name to a terrorist group.

The New York State Office of Homeland Security will compile, update and maintain a list of organizations who engage in or pose a terrorist threat.

Criminal sale of an Internet domain name to a terrorist group is a class A misdemeanor.

Justification

A study conducted by the Intelligence and Terrorism Information Center at Israel's Center concluded that the importance of the Internet as a means of marketing terrorism became significantly greater after September 11. The Web makes it relatively easy for terrorists and their supporters to evade detection and disseminate their messages and plans.

This legislation seeks to make more difficult in New York State for known terrorist organizations to obtain the domain space necessary to spread their message by establishing the crime of criminal sale of an Internet domain name to a terrorist group.

Effective date
