BILL NUMBER:S1604

Title of bill

An act to amend the general obligations law, in relation to the implementation of child support enforcement

Purpose of bill

Requires those individuals applying for recreational licenses in New York State to disclose his or her social security number and state whether or not they owe child support.

Summary of specific provisions

Section 1: includes "recreational activity" in the list of licensed activities which warrant disclosure of social security number and child support payment obligations;

Section 2: defines "license" and denotes its application to licenses for recreational activities;

Section 3: authorizes certain individuals to promulgate regulations on an emergency basis to ensure the implementation of this act;

Section 4: states this bill shall become effective 60 days after it shall have become law.

Justification

As per federal law, in order to receive federal funds states must have laws in effect which require an applicant for a professional or occupational license, a driver's license, and a marriage license to disclose his or her social security number and to certify whether he or she is under an obligation to pay child support. In 1997, the federal act was amended to add that states must require these disclosures when applying for recreational licenses. This bill amends the General Obligations Law so that it complies with the federal regulations.

Legislative history

First introduced in 2003.

Fiscal implications
