BILL NUMBER:S1818
Title of bill
An act to amend the labor law, in relation to asbestos projects
Purpose
To exempt municipalities from the payment of asbestos project notification fees when the project is funded by RESTORE monies.
Summary of provisions
This bill would amend Labor Law Section 904 subdivision 2 to relieve contractors of municipalities performing asbestos projects which are funded in part by RESTORE monies from paying the project notification fee.
Justification
Project notification fees for asbestos were doubled in the recently enacted budget. These increased fees adversely impact municipalities that are using RESTORE funding to remove vacant residential buildings. The project notification fees charged to municipalities by contractors performing the removal are paid out of RESTORE monies by the municipality. This situation effectively results in the state paying itself to the detriment of the RESTORE program. This project notification fee limits the RESTORE monies' value and decreases the number of vacant residences which may be removed.
This limited exemption from the payment of the asbestos project notification fee would enable municipalities to use RESTORE funding for its intended purpose the removal of vacant buildings, which are resulting in blight, drug havens and create hazards for fire and the firemen who respond to such fires.
