BILL NUMBER:S1902
Title of bill
An act to amend the penal law, the criminal procedure law and the judiciary law, in relation to increasing the minimum sentence for a second violent felony offense; and to repeal section 70.08 of the penal law relating thereto
Summary
This bill amends subdivision 6 of section 60.05 of the penal law, as amended by chapter 410 of the laws of 1979, among others. This bill would increase the penalty for persistent violent felony offenders to a minimum sentence of 25 years and a maximum sentence of life imprisonment, regardless of felony classification. This bill would also decrease the number of prior felonies necessary to classify an offender as a persistent violent felony offender from two or more to one or more.
Justification
This bill has been introduced in an attempt to remove the threat of repeated acts of violence against our citizens by creating a strong deterrent to would-be violent felons. It would also prohibit felons from repeating their crimes by increasing jail terms for offenders who have committed one or more violent felonies.
Fiscal implications
To be determined.
Effective date
The act shall take effect on the first of November next succeeding the date on which it shall have become a law and shall apply to offenses committed on or after such effective date.
