BILL NUMBER:S2011
Title of bill
An act to amend the civil service law, in relation to unclassified service of civil divisions of the state
Purpose
Designates local employees exercising executive functions of the chief executive officer, as unclassified service employees.
Summary of provisions
Subdivisions (j) and (k) of section 35 of the civil service law, subdivision (j) as amended by chapter 723 of the law of 1965 and subdivision (k) as added by chapter 1054 of the laws of 1969, are amended and a new subdivision (1) is added to read as follows: (1), all persons employed by a civil division of the state who principal functions and duties are directly related to the executive functions of its mayor, supervisor or chief executive officer.
Justification
Currently, all officers and employees of any municipality whose principal functions and duties are directly related to the performance of the executive functions of its respective municipal Mayor or Supervisor are required to take civil service exams for their position while legislative staffs of said municipality are general appointments.
