Title of bill
An act to amend the elder law, in relation to making technical corrections with respect to the activities of the office for the aging
Purpose/summary of provisions
To revise the functions and duties of State Office for the Aging as a means for making it a more effective agent in developing programs and services for the Aging. Technical revisions are made to Sections 535, 536, and 540 of the Executive Law which set forth the function and duties of the State Office for the Aging.
The following amendments contain new material:
Section 536 - General powers and duties of office 2 (b) Establishes primary responsibility for coordination for the Office of the Aging (c) Broadens the educational and public information function of the office (l) Establishes a link with volunteer services (m) Provides a forum for input from aging individuals and the area agencies on aging.
Section 536-a - Programs for the Aging 2 (f) Changes "retired senior volunteer programs", to "volunteer programs provided by older persons" Section 540 - Reports 1 Provides for a three-year plan for aging 2 Enlarges on interim reports 3 Establishes January 31st for annual report 4 (a) Adds implementation of triennial plan (b) An evaluation of the impact of a growing older population in descriptive material for the annual report. 5 (a) Adds report on informal caregivers (b) Adds housing report (rather than a report on substandard housing) (f) Changes report on hot meal program to "nutritional programs" (g) Changes report on extent of adult education courses to "educational opportunities" (h) Adds technical assistance, particularly for self-help groups (i) Adds home and community services.
Justification
The Office for the Aging was established in 1961. In 1965, the Federal Older Americans Act was signed into law. Subsequent State laws were enacted to implement the mandates of the Older Americans Act and the State Community Services for the Elderly Program established in 1979. Since that time, the impact of the increasing aging population and the many changes in the status of that population have not been reflected adequately in Executive Law. Some of the functions and powers of the office are no longer fulfilled or significant. New programs and needs have not been inserted in reporting requirements. In addition, the annual report has served as a review of present programs but not as an instrument for focusing future policy and program priorities.
Fiscal implications
None.
