BILL NUMBER:S2081

Title of bill

An act to amend the private housing finance law, in relation to the elimination of power to remove tenants who exceed maximum income limitations and repealing subdivision 5 of section 31 of such law relating thereto

Purpose/summary of provisions

This bill would amend Private Housing Finance Law 31(3) to eliminate the provision whereby a person or family in occupancy can be removed from a project under the Private Housing Finance Law due to income exceeding the maximum prescribed limits.

Justification

The Mitchell-Lama program was instituted as a means of attracting and holding middle-income families in areas which otherwise would be unattractive to them. Where the program has been successful by stabilizing an area with middle-income people, it should not be defeated by forcing such families to move. These families have made a place for themselves in a community and are adding to the economic vitality of the area. The fact that there are families who are able to afford higher rents is realized and dealt with by the imposition of surcharges, and should not result in displacement of families who have made a home for themselves.

Existing law

None.

Fiscal implications

None to the state.

Effective date

This act shall take effect on the sixtieth day after it shall have become a law.
