BILL NUMBER:S2267
Title of bill
An act to amend the general business law, in relation to extending the time for termination of membership in a private club
Purpose/summary of provisions
To expand the window of time for termination of membership in a private club to 90 days. This act amends section 624 of the general business law, in relation to extending the period in which to terminate memberships in private clubs to ninety days.
Justification
Increasing numbers of individuals have found it difficult to end their memberships with private clubs. It is the hope that by extending the time for notification of intent to terminate, that individuals wishing to cancel their memberships will have sufficient time with which to serve notice. Currently, members of a private club are required to serve notice thirty days prior to the anniversary date of their contract. Clubs are not required to notify members of their anniversary and many memberships are automatically extended. Although it is important for clubs to maintain some degree of stability in membership, the current system has proven to unfairly burden the consumer.
Fiscal implications
None.
Effective date
This act shall take effect on the thirtieth day after it shall have become law.
