BILL NUMBER:S2429A
Title of bill
An act to amend the transportation law, in relation to the erection of certain towers on special parkway lands
Purpose
To provide for comment prior to the erection of certain towers on lands of special parkways.
Summary of provisions
The bill would require the Department of Transportation, prior to erecting, causing or permitting to be erected, granting easements or licenses for, or otherwise facilitating the erection of any tower on lands of the special parkways, to notify the city, town or village in which the lands are located and to provide them a minimum thirty day comment period.
Justification
In cases where the State determines communication towers, including cell towers, are to be erected on special parkway lands, it should recognize the traditional role of local governments as purveyors of land use policy. Obtaining comment from the applicable local government before allowing such permanent and readily observable towers to be erected would ensure that local concerns can be advanced.
