BILL NUMBER:S2457
Title of bill
An act to amend the environmental conservation law, in relation to creating the state urban pesticide board and providing for the repeal of certain provisions upon expiration thereof
Purpose
To investigate the selling and usage of industrial strength pesticides in urban areas, to step up enforcement of existing restrictions on retail sales, and to educate the public about the hazards of using pesticides in the home.
Summary of provisions
The ECL is amended by adding a new title 17 to Article 33.
Section 1701 authorizes the creation of a ten member State Urban Pesticide Board within the Department.
Section 1703 outlines the functions, powers and duties of the board. Those powers shall include examining the patterns of pesticide use in urban areas, research of nontoxic alternative means for pest management in urban areas and examine the use and sale of illegal pesticides in urban areas. The Board will then make recommendations to the Governor and the Legislature regarding any policy reforms it deems necessary.
Section 1705 outlines the responsibilities of the department and other agencies.
Justification
Recent reports have revealed that industrial-strength pesticides are widely used in urban areas of New York State. More than one quarter of all pesticides reported to be applied in 1997 were in New York City. Most of these pesticides are extremely dangerous and residents are purchasing these toxic products for home use without awareness of the potentially severe health consequences for their children and families. The Board will examine, evaluate, and make recommendations concerning the sale, use, and application of industrial strength pesticides. Subsequently, the Board will submit with its reports, legislation that it deems necessary to implement its recommendations. The Board will prepare a brochure describing the dangers posed by the use and the exposure to the toxic substances.
