BILL NUMBER:S2569
Title of bill
An act to amend the education law, in relation to requiring physicians to procure and maintain malpractice insurance
Summary of provisions
This bill would amend the education law by adding a new subdivision 12 to section 6524 and a new subdivision 5 to section 6525.
Purpose
This bill would require that all physicians licensed to practice medicine in the state of New York procure and maintain in full force and effect a policy of medical malpractice insurance with coverage of at least $1 million per occurrence and $3 million in the aggregate.
Justification
Currently, in New York State, liability insurance policies with minimum limits are required in order to own an automobile. This law was established in 1957 so that the public could be protected from uninsured motorists. It only makes sense then that physicians should be required to have adequate insurance to protect the public from malpractice which may occur.
Fiscal implication
None.
Effective date
Immediately.
