BILL NUMBER:S2588

Title of bill

An act to amend the environmental conservation law, in relation to penalties for preventing the disclosure of information regarding contamination and the release of toxic substances

Purpose/summary of provisions

This bill would impose criminal sanctions for preventing the disclosure of information to local authorities, regarding the release of toxic substances, when that information is already available within state agencies.

Justification

Existing environmental conservation law does not currently mandate that state agencies divulge certain information, regarding toxic spills or releases. In the event of prolonged threat of illness or injury to a community due to the presence of toxic substances, whether under or above ground, local authorities must have access to this information in order to help alleviate the situation as quickly and efficiently as possible. This bill would facilitate that communication.

Fiscal implications

None. The information will have already been processed by the state agency; it just would be shared with other authorities.

Effective date

This act shall take effect on the first of November next succeeding the date on which it shall have become a law.
