BILL NUMBER:S2676

Title of bill

An act to amend the executive law, in relation to unlawful discriminatory practices concerning work uniforms

Purpose

This bill would make it unlawful for any employer, labor organization, or employment agency who or which requires employees to perform their duties wearing a specified work uniform to prohibit employees from wearing any article of religious headgear.

Summary of provisions

Section 296 of the executive law is amended by adding a new subdivision 20 which would make it an unlawful discriminatory practice for any employer, labor organization, or employment agency who or which requires employees to perform their duties wearing a specified work uniform to prohibit employees from wearing any article of religious headgear unless such prohibition is reasonably related to the health or safety of employees while on the job.

Justification

Recently, there have been a number of cases where an employee has faced disciplinary reprimand and potentially the loss of their job if the employee did not remove an article of clothing which the employee wore in observance of their religion.

Fiscal implications

None.

Effective date

This act shall take effect immediately.
