BILL NUMBER:S2956

Title of bill

An act to amend the agriculture and markets law, in relation to requiring approval of the commissioner of agriculture and markets for the compromise of any fine or penalty relating to kosher violations

Summary

This bill amends Section 201-d of the Agriculture and Markets Law to prohibit any penalty, fine, civil or criminal, violation of kosher enforcement laws to be compromised or reduced without the approval of the Commissioner of Agriculture.

Justification

Currently, the Attorney General's office has the power to compromise or reduce any penalty or fine imposed on kosher food establishments for violation of kosher enforcement laws, without needing the consent of the Commissioner of Agriculture. This occurs very often and therefore lightens the penalty on the kosher establishments for violating kosher enforcement laws. This bill would make it tougher for this to take place, because of the approval needed by the commissioner for the penalty to be reduced.

Fiscal implication

None.

Effective date

This act shall take effect on the thirtieth day after it shall have become a law.
