BILL NUMBER:S2961

Title of bill

An act to amend the general municipal law, in relation to rights of action to certain injured or representatives of certain deceased police officers

Purpose summary of provisions

This bill allows police officers to maintain an action for damages against an individual who injures the officer during the performance of his/her duty.

Existing law

Amends section 205-e of the General Municipal Law by adding a new subdivision 4.

Justification

Section 205-e has evolved over time to extend a negligence cause of action to police officers injured or killed in the line of duty. This amendment would hold the perpetrator of an injurious action liable, whereas in the past the supervisory authorities were solely liable for any negative results.

Fiscal implications

None.
