BILL NUMBER:S3099A

Title of bill

An act to amend the vehicle and traffic law, in relation to increasing the penalties for passing a stopped school bus

Purpose or general idea of bill

To increase the penalties for passing a stopped school bus.

Summary of specific provisions

Section 1: Amends Subdivision c of section 1174 of the vehicle and traffic law to allow for additional penalties for an individual convicted of passing a stopped school bus.

Section 2: Amends Paragraph b of subdivision 2 of section 510 of the vehicle and traffic law to include a new subparagraph (xvi) which provides for a sixty day suspension of an drivers license when the holder is convicted two or more times of passing a stopped school bus within a period of ten years.

Section 3: Effective date.

Justification

Current law provides that an individual convicted two or more times of speeding in a construction zone be subject to a sixty day suspension of his or her drivers' license. Passing a stopped school bus two or more times however, does not currently carry such a penalty. There is no doubt that passing a stopped school bus possesses as much, if not more, risk to life and limb as speeding in a construction zone and thus should have congruous penalties.
