BILL NUMBER:S3216

Title of bill

An act to amend the election law, in relation to the number and use of voting machines in village elections and providing for the repeal of such provisions upon expiration thereof

Purpose or general idea of bill

This bill allows villages which administer their own elections independent of local boards of election to use lever voting machines in the administration of said elections until December 31, 2012.

Summary of specific provisions

Section 1 of the bill states that villages which have not adopted a resolution allowing their local board of election to administer village elections may use lever voting machines in the administration of said election in lieu of the voting machines that have been approved by the State Board of Elections and currently in use by Boards of Elections throughout the state.

Section 2 makes it clear that the use of lever voting machines by villages in village elections shall not require local Boards of Elections to maintain, care for, store, or control these machines.

Section 3 specifies that this act shall take effect immediately and shall expire and be deemed repealed on December 31, 2012.

Justification

Current law requires that voting machines used throughout New York be those certified by the State Board of Elections. Pursuant to the voting modernization act adopted by the state the only machines currently certified are the electronic voting systems.

Lever voting machines have been successfully used throughout New York for over 100 years. The cost of using the lever machines is significantly less than the electronic machines. Electronic machines must be programmed and tested by the county boards of elections for extended periods of time, in addition the cost of scannable paper ballots for use in these machines is upwards of fifty-five cents apiece.

This bill gives the villages throughout the state the option to use the new electronic machines or the lever machines. This relief from the current state mandate will result in a significant cost savings to village taxpayers and give villages the opportunity for an orderly transition into the new machines over the next two years. This bill provides the same relief to villages that was provided to school districts last year.

Prior legislative history

None.

Fiscal implication

None to the state, cost savings to the county boards of elections and villages.

Effective date

This bill would take effect immediately provided, however, that the authority to use lever machines will expire on December 31, 2012.
