BILL NUMBER:S3386

Title of bill

An act to amend the penal law, in relation to chemical treatment of sex offenders

Purpose

To require the chemical castration of convicted repeat sexual offenders and to provide for possible chemical castration of first time sexual offenders.

Summary of provisions

Currently, convicted sexual offenders do not undergo any medical treatment to help control their sexual deviance once released back into the community. This legislation will provide medical treatment for repeat and possible first time sexual offenders in order to help control their sexual behavior. The legislation provides for an evaluation of the offender by a medical expert to determine appropriate candidacy for the treatment. The failure by the accused to comply with the provisions of this legislation shall be a Class A misdemeanor.

Justification

This legislation targets those criminals who have been convicted of a crime in which recidivism rates are high. It aims to help these people to use medication to control their behavior in the hopes of preventing them from repeating their crimes and of allowing them to function as a productive member of the community.

Legislative history

S.2540, 2009-10; S.2680, (2007-08); S.1003, (2005-06); S.1115, (2003-04); S.3105, (2001-02); S.4612 (1999-00); S.7109 (1997-98).

Fiscal implications

This bill has a negligible fiscal impact for the foreseeable future as sexual offenders are currently incarcerated and any costs associated with this legislation would not be borne until such offenders were released. At that time the costs of the treatment will be borne by the offender based on such offenders ability to pay. This legislation will substantially lower the recidivism rate among offenders helping to relieve the state of future incarceration costs for this group and injecting their productivity into the state's economy.

Effective date

This legislation shall take effect on the first day of November next succeeding the date on which it shall become a law.
