BILL NUMBER:S3441

Title of bill

An act authorizing the town of Southampton to accept from the Southampton union free school district applications for exemptions for real property taxes

Purpose or general idea of bill

This legislation authorizes the Town of Southampton to accept from the Southampton Union Free School District applications for exemptions for real property taxes.

Summary of specific provisions

An act to authorize the Town of Southampton to accept from the Southampton Union Free School District applications for exemptions for real property taxes pursuant to section 408 of the Real Property Tax Law for the 2009-2010 and 2010-2011 assessment rolls for the parcel owned by Southampton UFSD located at 1020 Majors Path, Southampton.

Justification

Majors Path Associates, LLC, conveyed a parcel of property known as Majors Path to the Southampton UFSD on March 18, 2010 as a public benefit as part of an agreement with the Town of Southampton to permit development of condominiums on an adjacent parcel of property.

Unfortunately, the taxable status date set forth in the Real Property Tax Law, Section 302, is March 1st. As a result, the District, which is in all other aspects a tax exempted entity, is being charged taxes on Majors Path for the 2010-11 tax roll ($8,335.98). In addition, the District is also being charged arrears from the 2009-10 tax roll which relates back to the date when the District took title to the property ($4,135.61).

This legislation is necessary to authorize the Town of Southampton to accept from the Southampton Union Free School District applications for exemptions for real property taxes pursuant to Section 408 of the Real Property Tax Law for the 2009-2010 and 2010-2011 assessment rolls.
