BILL NUMBER:S3475B

Title of bill

An act to amend the agriculture and markets law and the general business law, in relation to pet dealers

Purpose

To protect a greater number of consumers of dogs and cats by increasing the number of people considered to be "pet dealers" with regard to state inspections and already existing consumer protections laws.

Summary of provisions

Section one amends subdivision 4 of section 400 of the agriculture and markets law, as amended by chapter 687 of the laws of 2006, and adds a new subdivision 5. Subdivision 4 provides that the definition of "pet dealer" shall include any person who: sells or offers for sale nine or more dogs or cats born or raised on premises other than the premises of said person; maintains a total of six sexually intact female dogs or cats six months of age or older and who sells or offers for sale any of the offspring of such dogs or cats; or sells or offers for sale to the public ten or more dogs or cats in a calendar year. Subdivision five provides the definition of "premises."

Section two amends subdivision 3 of section 752 of the general business law, as amended by chapter 687 of the laws of 2006, to provide that the definition of "pet dealer" shall include any person who: sells or offers for sale nine or more dogs or cats born or raised on premises other than the premises of said person; maintains a total of six sexually intact female dogs or cats six months of age or older and who sells or offers for sale any of the offspring of such dogs or cats; or sells or offers for sale to the public ten or more dogs or cats in a calendar year.

Section three provides the effective date.

Justification

Currently, many breeders and sellers of animals who operate without proper oversight do not follow humane practices. The conditions in which many animals exist are very poor and lead to health problems for the animals. This legislation expands the definition of "pet dealer" to include breeders and sellers of animals who are not currently considered pet dealers in order to allow for oversight by the department of agriculture and markets. This will help to ensure that animals bred and sold in New York are treated humanely and consumers receive companion animals that are healthy.

Effective date
