Purpose

To amend Chapter 290 of the laws of 2005 in relation to providing immunity from liability for persons who voluntarily render emergency services and receive awards or benefit service awards.

Summary of provisions

Section 1. Amends subdivision 6 of Section 3013 of the Public Health Law as added by Chapter 290 of the laws of 2005 to ensure that providers of voluntary emergency services are immune from liability if they receive service awards or benefit service awards provided by Article 11-AAAA of the General Municipal Law. Such awards or benefits shall not be considered monetary compensation for the purposes of this Section.

Section 2 is the effective date.

Existing law

Chapter 290 of the Laws of 2005 added subdivision 6 of Section 3013 of the Public Health Law to ensure providers of voluntary emergency services are immune from liability if they receive service awards or benefit service awards provided by Articles 11-AA or 11-AAA of the General Municipal Law. Immunization is not currently available to service awards provided by Article 11-AAAA of the General Municipal Law.

Justification

This is an amendment to Chapter 290 of the Laws of 2005 which provided that providers of volunteer emergency services are immune from liability if they receive service awards provided by Articles 11-AA or 11-AAA of the General Municipal Law.
