BILL NUMBER:S3574

Title of bill

An act to amend the education law, in relation to prekindergarten transportation

Purpose

To allow school districts to provide prekindergarten bussing to its students who attend a program run by the district and not operated pursuant section 3602-e of the education law

Summary of provisions

Bussing may be provided, after referendum to prekindergarten students in a district which operates a prekindergarten program

Existing law

The commissioner of education has ruled that existing state law did not allow for the bussing of prekindergarten students who did not attend a universal prekindergarten program. This ruling was upheld by a decision of the state Supreme Court.

Justification

It is appropriate public purpose for prekindergarten students to be bussed to a program run by its district. This bill would allow for such bussing after mandatory referendum.
