An act to amend the general municipal law, in relation to dedicating veterans' memorials as parklands in the state of New York
Purpose
To provide statutory protection for veterans' memorials on public property throughout New York State.
Summary of provisions
Section 1 amends the general municipal law by adding a new subsection to provide that any public property donated to or designated by a state or local governing body for the purpose of creating or maintaining a memorial to the veterans of any armed conflict engaged in by the armed forces of the United States be considered parkland, and subject to all legal provisions afforded to designated parkland in New York State.
Section 2 states that this law shall take effect immediately.
Justification
This legislation designates veterans memorials on publicly owned property as parkland and affords such property the protection of existing state procedures related to the alienation of parkland when such changes are considered.
Currently, there are not adequate protections in law to protect veterans' memorials.
