BILL NUMBER:S3743A

Title of bill

An act to amend the penal law, in relation to distribution and dissemination of obscene material

Purpose

To prohibit the distribution of material depicting nudity, actual or simulated sexual conduct, sado-masochistic abuse and/or nudity.

Summary of provisions

This bill amends the definition of "obscene" in Penal Law Section 235.00 to include images that depict "nudity," "pubic area," "buttocks" and "female breasts."

This bill also specifically makes it a crime to distribute or disseminate obscene materials. Current law only bans the promotion of such material.

Penalty will be a class A misdemeanor.

Justification

The distribution of business-size cards with images of scantily clad and/or naked men and/or women are common along the street of Roosevelt Avenue in Queens. These cards are routinely collected and traded like baseball cards by children.

The quality of life within a neighborhood is diminished when items like these are so easily accessible. These cards are indicative of a larger issue; the sex trade industry.

This bill will enable law enforcement to remove the distributors of these cards from the street and give the district attorney the authority to prosecute; an ability currently absent.

This is the first step toward cleaning up Roosevelt Avenue. Ignoring small problems, nuisances and visually offending items can be a factor in the image of a neighborhood in decline.
