BILL NUMBER:S3755B
Title of bill
An act to amend the public authorities law, in relation to the eligibility of independent institutions of higher education to receive assistance from the New York power authority in establishing energy efficiency and clean energy initiatives
Purpose
The purpose of this bill is to allow independent not-for-profit colleges and universities to access energy-related projects, programs and services of the New York Power Authority ("NYPA"), and to expand the scope of NYPA's "energy-related projects, programs and services."
Summary of provisions
Paragraph a of subdivision 17 of section 1005 of the public authorities law, as amended by section 16 of part CC of chapter 60 of the laws of 2011 is amended, to add independent not-for-profit institutions of higher education to the list of entities that are eligible to access the energy-related projects, programs and services of NYPA.
Section 2 of this bill would provide for the bill's effective date.
Justification
Public Authorities Law authorizes NYPA to design, develop, finance, construct, implement or provide and administer energy-related projects, programs and services for public entities and for recipients of various NYPA power allocation programs. The purpose of this provision is to enhance the energy efficiency, clean energy, energy service and green building programs administered by NYPA, to reduce energy consumption and mitigate environmental impacts from energy usage consistent with the State's energy and environmental policies.
Authorizing independent not-for-profit colleges and universities to access NYPA's energy-related projects, programs and services, and expanding the definition of "energy-related projects, programs and services" would further these laudable goals. In addition, providing these colleges and universities with access to NYPA's programs and services could help such institutions reduce their energy costs which in turn could have favorable impacts on tuition and fees.
Effective date
This bill would take effect immediately.
