BILL NUMBER:S3898
Title of bill
An act to direct the department of environmental conservation to authorize the installation of a dry hydrant on Colgate Lake in the town of Jewett, county of Greene
Purpose or general idea of bill
Authorizes the Department of Environmental Conservation (DEC) to permit a dry hydrant for the Town of Jewett.
Summary of specific provisions
This legislation would amend the State Law to permit the construction of a dry hydrant as defined by the state fire code at Colgate Lake in the Town of Jewett.
The second section of this bill provides for an immediate effective date.
Justification
The Catskill Park State Land Master Plan does not allow the installation of dry hydrants as fire control devices because they are not defined as conforming use structures in the park's current land use regulations. The Town of Jewett appealed to DEC as the park's master plan was revised just two years ago so that these structures would be included in the updated use plan, but the department rejected the town's request to add the necessary language.
The Town of Jewett's officials, fire district and safety administrators, and residents feel that this element is a necessary addition for the health and safety of the park's surrounding communities. Accordingly, this legislation seeks to authorize the town to install a dry hydrant at Colgate Lake for public safety and fire control purposes.
Prior legislative history
New Bill.
Fiscal implications for state and local governments
None to the state. Costs associated with installing the dry hydrant and necessary fire control infrastructure would be borne by the Town of Jewett or appropriate fire district.
Effective date
This act would take effect immediately.
