BILL NUMBER:S3965

Title of bill

An act to amend the labor law, in relation to enhancement of provisions relating to child performer employment permits

Purpose of bill

This bill will expand the effective period for child performer employment permits granted by the Commissioner of Labor from six months to one year.

Summary of provisions

Section 1 of the bill would amend Labor Law § 151(1) to extend the period of validity for a child performer employment permit from six months to one year.

Section 2 of the bill would establish an immediate effective date.

Existing law

Paragraph Labor Law § 151(1)(b) makes an employment permit for a child performer valid for six months.

Prior legislative history

This is a new bill.

Statement in support

This legislation sets forth a new provision that would relieve the parents or guardians of child performers of the obligation to secure a new employment permit for their children every six months. This change effectively would reduce the burden on parents and guardians to permit employers to retain services of child performers on a more continuous basis without fear that permits will expire mid-employment, and reduce the administrative burden upon the Department to process these permits.

Budget implications

The extension of the period during which a child performer employment permit is effective is not anticipated to have a fiscal impact on the Department.

Effective date

This bill would be effective immediately.
