BILL NUMBER:S4011A
Title of bill
An act to authorize Pamela Lewanduski to purchase 10 months of military service credit on behalf of her deceased husband Edward F. Lewanduski
Purpose
Allows Pamela Lewanduski, the widow of State Police Officer Edward F. Lewanduski, to receive an ordinary death benefit based on his pension reserve by retroactively allowing her to purchase credit for his military service.
Summary of provisions
Allows Pamela Lewanduski to retroactively purchase ten months of military service for her late husband's service in the United State Marine corps from July 1977 through June 1981, to be used in the calculation of Mr. Lewanduski's ordinary death benefit.
Justification
Edward F. Lewanduski served in the State Police for over nineteen years when he passed away on June 12, 2004, just short of the twenty years necessary to receive an ordinary death benefit based on his pension reserve. From July 1977 through June 1981, Edward F. Lewanduski served courageously in the United States Marine corps and was awarded medals for his service. Unfortunately, due to a technicality in the Retirement and Social Security Law, he was ineligible for military credit towards his retirement. Under this legislation, Pamela Lewanduski will be allowed to purchase enough military service credit necessary to attain the twenty years of service required for an ordinary death benefit based on her late husband's pension reserve. This legislation honors Edward F. Lewanduski for his service to his state and to his country by granting his family the death benefit he should have been entitled to.
