BILL NUMBER:S4048A
Title of bill
An act granting retroactive tier IV membership in the New York state and local employees' retirement system to Michelle Merlino
Purpose
This bill would grant Michelle Merlino retroactive tier IV membership in the New York State and Local Employees' Retirement System.
Summary of provisions
Section 1 of the bill changes Ms. Merlino's effective membership date in the New York State and Local Employees' Retirement System from March 18, 2010 to November 14, 2008 so that she may be placed in the Tier IV retirement group. She shall file with the State Comptroller a written request to this effect and, upon granting of such retroactive membership, Ms. Merlino will not be granted a refund of any employee contribution made by her to the system.
Section 2 describes who is responsible for any past cost incurred in implementing the provisions of this act.
Section 3 provides the effective date.
Justification
Michelle Merlino commenced employment in the Deer Park Union Free School District on November 14, 2008. which should have entitled her to Tier IV membership in the New York State and Local Employees' Retirement System. However, Ms. Merlino's application to the retirement system was submitted inadvertently on a day she did not work. Once the error was discovered she resubmitted her application on a later date, but was placed in Tier V instead of Tier IV. The late filing was due to a clerical error on the part of the Deer Park Union Free School District and not due to an error on the part of Ms. Merlino and, as such. she should not be penalized for the late filing.
This bill, if enacted into law, would correct the mistake by allowing Michelle Merlino to file for retroactive membership in the New York State and Local Employees' Retirement System as of November 14, 2008, the day of her actual employment.
