BILL NUMBER:S4571
Title of bill
An act to amend the tax law, in relation to extending the authorization for Ontario county to impose additional rates of sales and compensating use taxes
Purpose or general idea of bill
Extends the application of the Ontario county sales and compensating use tax until November 30, 2013.
Summary of specific provisions
Section 1. Clause 40 of Subparagraph (i) of the opening paragraph of section 1210 of the tax law, as added by chapter 94 of the laws of 2009, is amended to read as follows: (40) the county of Ontario is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate that is one-eighth of one percent additional to the three percent rate authorized above in this paragraph for such county for the period beginning June first, two thousand six and ending November thirtieth, two thousand thirteen.
Justification
Ontario County is one of the very few counties in New York State which does not currently collect an additional sales tax above the three percent rate authorized by state law without special legislation. Ontario County is requesting by home rule request, that the county be authorized to collect an additional sales tax amount of one-eighth of one percent which is still a lower percentage than any other area county surrounding Ontario County, and which would subsequently be the lowest additional sales tax percentage rate authorized by special legislative approval throughout New York State.
