BILL NUMBER:S4608A
Purpose
This legislation would allow the Town of Huntington to sell certain unused park lands.
Summary of provisions
Section 1 of the bill authorizes the Town of Huntington to discontinue the use of and sell certain land identified as park lands.
Section 2 of the bill requires the Town of Huntington to apply the proceeds of sale for the purchase of additional park lands.
Section 3 of the bill describes the metes and bounds of the park lands to be conveyed.
Justification
Located within the Town of Huntington are certain pieces of land that in 1972, were conveyed to the Town of Huntington with a restriction that the parcels, which are both landlocked and surrounded by senior citizen housing, be used exclusively for community park purposes principally for the benefit of the neighboring senior citizens housing facility. The parcels have been repeatedly vandalized and act as an attractive nuisance. Their continued existence as park lands jeopardizes the elderly residents of the surrounding senior citizen housing complex who do not use the parcels due to safety concerns. There being no prospect for the parcels to continue to be utilized as park land, and rather than have the parcel remain in its present condition, it is appropriate for the parcels to be sold and developed. In accordance with the law, the proceeds of such sale will be used for the purchase of additional park lands within Huntington.
