BILL NUMBER:S4640C
Title of bill
An act to amend the education law, in relation to licensure of perfu- sionists; and providing for the repeal of such provisions upon expira- tion thereof
Purpose
Amends the education law to allow perfusionists to directly perform laboratory tests necessary to their job of running machines essential to certain procedures (e.g. open heart surgery and organ transplants).
Summary of provisions
Section 1: Amends section 8609 of the education law by adding new subdi- vision 9. This addition allows perfusionists working under the super- vision of a physician to acquire a temporary permit to perform essential tests in the operating room.
Section 2. Establishes the effective date.
Justification
Recent changes to the education law that required certain laboratory tests to be performed by licensed professionals had the unintended consequence of forbidding perfusionists from directly performing tests essential to the proper operation of machines they operate during surgery. This forced them to get another licensed professional to perform tests that they had previously done themselves while monitoring their machines. This situation has created a risk of error in the oper- ating room, and led to delays in surgery. This bill will correct this problem by allowing perfusionists to once again perform these tests through a temporary permit structure. This provision will expire on July 1, 2014.

Fiscal implications
None to the state.
Effective date
This act shall take effect on the ninetieth day after it shall become a law and shall expire and be deemed repealed by July 1, 2014.
