BILL NUMBER:S4656

Title of bill

An act to amend the penal law, in relation to the criminal sale of controlled substances on school grounds

Purpose

To include day care facilities within the definition of "school grounds" for the purposes of controlled substances offenses.

Summary of provisions

Section 1 of the bill amends subdivision 14 of section 220.00 of the penal law to include day care facility within the definition of school grounds

Section 2 of the bill provides for an immediate effective date

Justification

Presently, sections 220.34 and 220.44 of the Penal Law prohibit the criminal sale of a controlled substance to youths under 19 years of age on school grounds or within 1000 ft. of the property line. This bill will make the same criminal penalty apply to those selling drugs within a 1000 foot vicinity of day care facilities. This bill would simply include "day care facility" within the definition of school grounds, reinforcing New York State's dedication to protecting children in their most vulnerable environments from the illicit sale of drugs.
