BILL NUMBER:S4696

Title of bill

An act to amend the public service law, in relation to clarifying the mandatory time within which the public service commission must act upon petitions submitted by regulated entities and the citizenry

Purpose

Requires the Public Service Commission to take action on petitions submitted by citizens and other interested parties in a more expeditious manner.

Summary of provisions

Section 1: Amends §5 of the Public Service Law by adding two new subdivisions 7 and 8.

Justification

Legislative hearings have recently revealed that the Public Service Commission ("PSC") has inadequately addressed petitions filed with it, Le. petitions filed by citizens have been open for several years or the Commission has not taken any action on a petition.

For example, Legislative staff, based on rough data provided by the Commission, have found the following case loads still open:

* 69 cases filed in 2002 * 95 cases filed in 2003 * 143 cases filed in 2004 * 321 cases filed in 2005 * 665 cases filed in 2006

The Commission has a responsibility to quickly address petitions filed by citizens and other groups to make sure those utilities the Commission regulates operate in the public interest.
