BILL NUMBER:S4730
Title of bill
An act to amend the education law, in relation to the apportionment of state assistance to school districts for school years commencing on or after July 1, 2011
Purpose
To implement a streamlined and simplified school aid formula, developed by the Statewide School Finance Consortium, so as to improve equity in the funding of school districts.
Summary of provisions
Adds a new section 3602-a to the education law to provide a formula for apportionment of state assistance to school districts.
Section 1 outlines the new school finance formula, developed by the Statewide School Finance Consortium, defines terms used in the legislation, and outlines the transitional steps to be taken in moving from the old school finance system to this formula.
Section 2 provides an effective date of July 1, 2011.
Justification
This bill implements the school finance reform plan proposed by the Statewide School Finance Consortium. This proposal contains five components:
1. Per pupil foundation aid of $9,708;
2. Extraordinary needs aid of $1,456 per pupil to recognize the cost of educating certain students;
3. "Property tax fairness" provision that ensures school districts pay a reasonable share of their school budget;
4. BOCES, building, transportation, and high-cost special education aid is unchanged; and
5. "Save harmless" provision to ensure no districts are adversely affected by the new formula.
This new formula would implement several improvements over the current system. This formula would equalize the tax burden for taxpayers receiving similar services. The bill implements a school finance system that would decrease the reliance of school districts on property taxes. The legislation establishes a system that is more predictable for taxpayers and school districts. Finally, the new formula would be straightforward and easy to understand.
