BILL NUMBER:S4830A
Title of bill
An act to amend the social services law, in relation to providing a model health care proxy form to individuals applying for medical assistance
Purpose
The purpose of this legislation is to require that individuals applying for medical assistance be provided with a model proxy form.
Summary of provisions
This bill would add new subdivision 1-a of section 366-a of the social services law.
Existing law
Individuals deserve to have their health care wishes honored, yet a large majority of New York residents do not have a health care proxy for times when they cannot express their health care preferences. As a result, their wishes are often unknown, and they might be given medical treatment that they would not want or not be given treatment that matches their choices. Requiring that individuals applying for medical assistance be provided with a model proxy form and other important health care-related documents will increase the awareness of these documents and spur more New Yorkers to complete them.
