BILL NUMBER:S4901
Title of bill
An act to amend the village law, the town law, the general city law and the not-for-profit corporation law, in relation to recognition of volunteer members of fire companies as duly elected and approved members of such fire companies
Purpose
To ensure volunteer firefighters are duly elected or approved members of their respective companies.
Summary of provisions
This bill amends Section 10-1006(16) of the Village Law; Section 176-b(14) of the Town Law; Section l6-a(13)(3) of the General City Law and Section 1402(h)(2) of the Not-for-Profit law by extending the date on which volunteer members of fire companies are considered to be duly elected and approved by their respective companies. The bill would extend from January 1, 2003 to January 1, 2011 the date on which duly elected approved members shall be recognized notwithstanding any legal defect in their election or approval process. This section has been similarly amended and updated several times over the past 30 years.
Justification
As stated, the pertinent sections being amended do confirm the appointment of firefighters, notwithstanding possible technical and minor errors or omissions in the approval process. This bill will update those sections. As the processing of the necessary forms and other time sensitive materials are completed by company personnel who are often part-time or not familiar with all the legal requirements, it is appropriate that the volunteers who give their time and effort to their communities not be concerned about their status as firefighters due to a minor or technical mistakes in their paperwork thus giving them all the rights and privileges of law including but not limited to coverage under the Volunteer Firefighters' Benefit Law.
