BILL NUMBER:S5032
Title of bill
An act to amend the transportation law, in relation to the New York city transit authority on-track and surface omnibus program
Purpose or general idea of bill
To provide the NY Transit Authority with a procedure that will ensure that busses are inspected and safe to drive on a daily basis.
Summary of specific provisions
Amends section 403 of the transportation law, as added by chapter 209 of the laws of 2007 to include surface vehicles in the requirements for inspection and safety procedures that currently exist to ensure that trains run by the New York Transit Authority are operated safely.
This bill also provides that procedures will be established that prior to the daily use of any surface or track to insure that vehicles are inspected before they are put into service to ensure they are safe. This bill also requires that no person should be compelled to operate a vehicle that does not pass inspection. Additionally there are Whistleblower protections to ensure the privacy and safety of people that report violations.
Justification
This bill will help to ensure that all surface vehicles being used by the MTA are inspected and in good working condition to provide all passengers with a safe ride. Current law mandates that mass transit systems operating surface omnibus service for the public-at-large comply with safety rules and regulations promulgated by the Commissioner of the Department of Transportation (DOT). Among those rules is a mandate to, on a daily basis, inspect any bus and rectify any defect noted on it prior to placing it in service for that day. This procedural mandate is not being faithfully followed by the Metropolitan Transit Authority, and even when an inspection is conducted, sometimes a failing bus is nevertheless deployed without the necessary corrective action undertaken. This legislation would ensure better compliance with the DOT safety mandates, and at the same time protect MTA employees who report any ongoing bus safety deficiencies to the MTA Inspector General. The bill further requires that any shortcomings in bus safety be recorded and reported to governmental entities having oversight over MTA operations.
