BILL NUMBER:S5088

Title of bill

An act to amend the education law, in relation to the transportation of children residing in a school district in the county of Westchester

PURPOSE:The purpose of this bill is to give school districts in Westchester County additional flexibility in shaping their own school transportation plans to transport children to public or private schools.

Summary of provisions

Section 1: Amends Education Law section 3635(1) to authorize school districts in Westchester County to reduce their obligation to transport school children from home to school from the current state mandated 15 miles to 7 miles. Such mileage restriction in the scope of transporting school district children must be adopted pursuant to a school board resolution.

Justification

The current law establishes an obligation for school districts to transport children at least 15 miles each way from home to school and then back to home again. While this requirement may be sound for school districts of large geographical size throughout this State, it may be a burden on certain school districts in Westchester County. For example, the square mile size of the following school districts are less than 4 square miles: Bronxville, 1 sq/mile, Eastchester, 3.69 sq/mile, Pelham 2.1 sq/mile, and Tuckahoe 2.25 sq/miles. For these geographically smaller school districts, the 15 mile transportation requirement may be overly high for these smaller school districts. This bill merely authorizes school districts in Westchester County to reduce their responsibility of transporting pupils to a shorter distance that more accurately reflects the size of the school district in question. Such mileage reduction may only occur after the school board in question adopts a resolution to authorize this change.
