An act to amend the town law and the public officers law, in relation to authorizing town justices in the town of Benson, in the county of Hamilton, to reside outside such town
Purpose
This bill will authorize the Town of Benson, in the county of Hamilton, to utilize town justices who reside outside the Town of Benson.
Summary of provisions
New York State Town Law is amended such that the town justice of the Town of Benson, in Hamilton County, need not reside in the Town of Benson.
Section 2 states that a person residing outside the Town of Benson in Hamilton County, in an adjoining town, shall not be prevented from holding the position of town justice in the Town of Benson.
Justification
This legislation will allow the Town of Benson to select the most qualified person to be the Town Justice of the Town of Benson, regardless of his, or her residency status.
