BILL NUMBER:S5530
Title of bill
An act to authorize Conrad B. Johnson to be granted service credit in the optional twenty year retirement plan of the New York state and local police and fire retirement system for certain service as a community service aide with the Suffolk county police department
Purpose or general idea of bill
This bill authorizes Conrad B. Johnson to be granted service credit in the optional twenty year retirement plan for certain service as a community service aide.
Summary of provisions
Section One of the bill authorizes Conrad B. Johnson, who is employed by the police department of the county of Suffolk to receive service credit for the purposes of section 384-d and 384-e of the retirement and social security law for the time he served as a community service aide with the Suffolk county police department. Such service shall be deemed to be police or fire service for the purposes of receiving retirement credit. Mr. Johnson shall be required to file a written request with the state comptroller in order to receive such payments. Section Two provides that all employer past service costs incurred pursuant to this act shall be borne by Conrad B. Johnson. Section Three is the effective date.
Justification
The Suffolk County police department is an employer electing to participate in the optional twenty-year retirement plan pursuant to sections 384-d and 384-e of the retirement and social security law. Mr. Conrad B. Johnson has been employed by the Suffolk county police department since March 3, 1980. From this date until February 24, 1985, Mr. Johnson was employed as a community service aide, which is not deemed to be police or fire service for the purposes of accruing credit for retirement benefits. This legislation would allow Mr. Johnson to receive service credit for the years of employment when he served as a community service aide for the police department provided he file this request with the state comptroller's office. Mr. Johnson would pay the service cost associated with this legislation, which has been estimated as $133,000 assuming payment date of February 1, 2012.
