BILL NUMBER:S5553
Title of bill
An act to amend the public health law, in relation to authorizing the commissioner of health to extend the use of audit findings to subsequent un-audit periods with regard to payments to patient service providers and assessments on covered lives
Purpose
To allow the Commissioner of Health the authority to enter into multi-year HCRA settlement agreements.
Summary of provisions
Section 1 of the bill would amend section 2807-j of the Public Health Law to authorize the Commissioner of Health to enter into agreements with designated providers of services and third-party payors, using previous audit findings and applying such audit findings for subsequent un-audited periods of time.
Section 2 of the bill would amend section 2807-t of the Public Health Law to authorize the Commissioner of Health to enter into agreements with designated providers of services and third-party payors, using previous audit findings and applying such audit findings for subsequent un-audited periods of time.
Section 3 - Provides this act would take effect immediately.
Justification
The bill would authorize the Department of Health to enter into multi-year settlement agreements with third-patty payors and Article 28-certified entities (hospitals and clinics) related to HCRA surcharge assessments. Currently, the Department of Health is authorized to enter into multi-year settlements for years through 2009. The multi-year settlement authority allows the Department of Health and third-party payers to take the audit findings from a defined audit period and apply such findings to unaudited future periods. These settlements have proven beneficial to the State, third-party payors and Article 28 entities by allowing payors or entities to pay HCRA assessments without having to expend the time and resources necessary to conduct full audits.
