BILL NUMBER:S5571
Title of bill
An act to amend chapter 851 of the laws of 1949, relating to establishing a police justice court in the village of Port Chester, in relation to hours for opening police justice court in the village of Port Chester
Purpose or general idea of bill
This bill establishes a second acting Police Justice to the Police Court in the Village of Port Chester.
Summary of specific provisions
Amending chapter 851 of the laws of 1949, relating to establishing a police justice court in the village of Port Chester, sections 4 and 10 as amended by chapter 447 of the laws of 1962 and section 6 as amended by chapter 410 of the laws of 1965, is amended as follows:
Section 2 creates a second acting police justice for the village of Port Chester. Currently there exist one police justice and one acting police justice. This bill increases the number of acting police justices to two.
Justification
The justice court is one of the most active courts in New York State. The village of Port Chester's comprehensive code enforcement efforts are expected to accelerate and significantly add to the already high caseload. Under the Police Court Act or the State Village Law the Village does not have the ability to add an additional justice to assist the police justice without special legislation. The Board of Trustees and the Mayor are therefore requesting a second acting police justice.
Prior legislative history
None.
Fiscal implications
Minimal to the village with no financial impact to the state.
Effective date
This act shall take effect immediately.
