BILL NUMBER:S5644
Title of bill
An act to amend chapter 474 of the laws of 1996, amending the education law and other laws relating to rates for residential health care facilities, in relation to payments by social services districts for public general hospitals
Purpose
Authorizes the social services districts and their public hospitals the option to select either Intergovernmental Transfers or certified public expenditures (CPEs) as a funding mechanism for certain already authorized Medicaid payments to public general hospitals.
Summary of specific provisions
Section 1 of the bill permits Medicaid funding obligations of a social services district in relation to specified Medicaid payments to be fulfilled through CPEs by public general hospitals located in the social services district. Section 2 provides for an immediate effective date.
Justification
Federal Medicaid law permits local government entities to fund the non-federal share of Medicaid payments through intergovernmental transfers (IGTs) or CPEs. New York currently funds certain supplemental Medicaid payments to public general hospitals through IGTs from the social services district in which the hospital is located. In some circumstances, IGTs raise cash flow problems for the social services district and the public hospital, as the use of IGTs requires that a significant amount of funds be reserved for transfer to the Department of Health.
The legislation would allow a social services district the option to use CPEs by its public general hospital to fulfill the funding obligation instead of IGTs. The Department of Health would be permitted to draw down matching federal funds on the basis of certified costs. The use of CPEs will resolve IGT related cash flow problems experienced by social services districts and public general hospitals, as there no longer will be a need to reserve local funds for transfer to the Department of Health.
