BILL NUMBER:S5754

Title of bill

An act to amend the education law, in relation to claims resulting from late filing of final cost reports by school districts

Purpose or general idea of bill

Amends the education law adding a new section altering the current penalty associated with the failure of school districts to file final cost reports.

Summary of specific provisions

Section 1. Provides for a ten percent penalty on the approved cost for school district construction projects when a district fails to file a final cost report.

Section 2. Conforming amendment to section 3602 of the education law.

Justification

Under current law when a school district fails to file a final cost report the aid associated with the approved project cost is recaptured by the state education department. This legislation will continue to provide a penalty when districts fail to file a final cost report but will not eliminate the entire amount of building aid on the project as is required under current law.
